The following General Conditions, Terms and Conditions of Sale and Data Processing Policy regulate the use of the website www.aurorathebrand.com, which corresponds to FERNANDEZ VINCENTIIS S.A.S. (trade name “aurora”) with NIT. 901415742-7 and domiciled at Cra. 5ª No. 36-16 Calle del Cuartel, Centro.
Through www.aurorathebrand.com, aurora provides information about its products and offers the possibility of purchasing them. Persons wishing to make purchases must register in order to be able to purchase what is offered as a “Customer”. Some sections of the website are accessible to people who are not registered. In this sense, Customers accept the terms and conditions contained in this document, to the extent that it may apply to them.
This policy applies to national and international users through the www.aurorathebrand.com website.

AVAILABILITY OF CLOTHING

aurora informs the Customer that the units available on the website correspond to the stock in the warehouse. In no case aurora will intentionally offer for sale more units than are not available.
aurora, in cases difficult to control such as human errors or incidents in computer systems, where the quantity in stock available differs from the order placed, aurora will inform the Customer via email of the total or partial cancellation of his order, so that he can select new items for his order or if the Customer requests a refund, this will be done in accordance with the stipulations in “REFUNDS”.

PRICES


The prices described in this website www.aurorathebrand.com are in Colombian pesos (including VAT and other taxes that may apply), U.S. dollars and Euros (Europe). All values described do not include the costs of shipping the products, except for international orders (other than Colombia), which are detailed in “SHIPPING METHOD” and must be accepted by the Customer.

PAYMENTS

The Customer agrees to pay at the time the order is placed, the clothing plus shipping costs. The total price to be paid will be previously shown to the Customer before finalizing the purchase. Payments are made through wire transfers, Paypal and in the case of cash on delivery Fedex and are subject to their conditions and security protocols. Customers may use credit cards, debit cards through PSE and/or cash payments.
When an electronic transaction (not applicable for Cash on Delivery) is rejected, the Customer may contact their bank directly to verify the cause of the rejection. If the payment is successful, the Customer will receive an e-mail to the e-mail registered in the purchase form. All transactions will be subject to verification of the actual deposit in the bank account of Fernandez Vincentiis S.A.S. (trade name “aurora”) and to additional verifications.
Although aurora has a secure connection system for the payment of all purchases, in no case will aurora be responsible for the failures in the communications of the banking entities, nor for the damages caused to the Clients by such entities.
In case of suspicion or verification of improper use of the payment gateway including attempted fraud, hacking activities or attempted violation of security systems, aurora may initiate appropriate legal action. aurora assumes no responsibility when the user has not proceeded to notify the corresponding financial institutions of the loss, misuse, theft or robbery of the instruments or personal information conferred by them to carry out transactions.
The Customer must notify aurora of any improper charge on the card used for purchases as soon as possible so that aurora can take the appropriate steps.

SHIPPING

Delivery of the product
aurora undertakes to deliver the product to the address indicated by the Customer in the shipping information form. In order to optimize the delivery, aurora suggests the Customer to indicate an address to which the order can be delivered during normal working hours.
aurora will not be held responsible for delivery errors caused when the delivery address entered by the Customer in the shipping data form does not correspond to reality, or when some data have been omitted.
The shipment of the order will be free of charge if it exceeds the minimum purchase value established in the promotion of the season.

Delivery Time
aurora ships via Federal Express Corporation (FEDEX). The order placed will be delivered within a period of time that depends on the location of the Customer as well as the cost varies for each population.
The Customer should note that non-business days such as Saturdays, Sundays or holidays do not count towards the total shipping time.
These times are an estimate. Therefore, it is possible that they may vary due to logistical reasons or force majeure. In case of delays in deliveries, aurora will inform the Customer as soon as it becomes aware of them.

Delivery Data, non-deliveries and lost deliveries

If the carrier is going to deliver an order and the Customer is not there; they will try again up to two more times (usually on consecutive days). If a delivery problem is reported, aurora will contact the customer to solve it. If aurora is unable to communicate, the order will be returned to our Distribution Center and the Customer will be responsible for the shipping costs.

Each delivery is considered completed from the moment in which the carrier makes the product available to the Customer, this is evidenced by the package tracking system used by the carrier, FEDEX.
If the reason for the non-delivery is the loss of the package, the transport company will initiate an investigation. In this case aurora will contact the Customer to make a new delivery or refund the money.

Problems at the time of delivery

The Customer must check the good condition of the package at the time of receipt. If after checking the product, the Customer sees signs of having been opened or identifies any imperfection caused in transport, it undertakes to communicate it to aurora as soon as possible within 48 hours of delivery. After that time no such incidents will be dealt with.

EXCHANGES, RETURNS AND GUARANTEES

To request an exchange or return, the Customer can contact the distributor with whom the purchase was made or directly with the company aurora in Colombia, explain the reason for which you want to make the exchange, return and / or warranty, and send the garment to our headquarters in Cartagena. Once received, the condition of the garment will be reviewed, taking into account that it is new, it is in perfect condition, it has all its labels and tags attached and has the corresponding purchase invoice.

Exchanges can be made within 30 calendar days from the date of purchase. Exchanges do not apply to underwear, but the quality guarantee does apply.

Clothing Exchanges
The changes through our website, must be notified to aurora to be approved, for this the following steps are detailed:
 
– To make a change you must call +57 3145160339 (either in writing or by phone) Monday through Friday from 8:00 am to 6:00 pm, Saturdays from 9:00 am to 12:00 pm. To 12:00 m.
– Exchanges or returns do not apply to used clothing.
– Clothing must have the aurora tags and labels attached.
– You have 60 calendar days from the time the clothing arrives to make the exchange.
– Underwear does not have an exchange, but does have a guarantee.
– Exchanges made on the website cannot be modified once the request has been made.

How to make an exchange?

1. Once the customer contacts aurora, we will reserve the clothes that the customer wants.
2. We will schedule a free pick up of your clothes to the address you give us.
3. When the clothes arrive we will verify that everything is ok and send you the new item. The shipping to your home is assumed by aurora.
4. If you have to pay any surplus or you have a balance due, we will send you all the information to your email.
5. If the clothes you sent us do not meet these conditions we can reserve the possibility of not making the exchange.

Guarantees

– To make a warranty you must contact the line +57 3145160339 (either in writing or by phone) Monday through Friday from 8:00 am to 6:00 p.m., Saturdays from 9:00 a.m. to 12:00 noon. To 12:00 m.
– Once the warranty is approved, we will exchange it for another product or refund your money.
– If you have to pay any surplus or you have a balance due, we will send you all the information to your email.
– If the clothes you sent us do not meet these conditions we can reserve the possibility of not making the guarantee.

The warranty is 90 days after purchase. The useful life of the garment depends on its care and conditions of use, so the warranty does not apply to products damaged by use, normal wear and tear or modifications to the garment.

New items upon receipt of the order
In case of any of the described novelties at the moment of receiving your order, you have a period of 7 working days (from the delivery) to inform us:
– Missing or surplus units
– Incorrect order

Returns

1. To make a return you must call +57 3145160339 (either in writing or by phone) Monday through Friday from 8:00 am to 6:00 pm, Saturday from 9:00 am. To 12:00 m.
2. You have 5 days to request a refund once you receive your clothes.
3. The customer must assume the shipping costs, aurora will not be responsible for the freight.
4. The return of money can take up to 30 calendar days, depending on the means of payment, in case of cash, the money will be deposited in a debit account.
5. If we do not receive your clothes within 20 days of your request we will assume that you have retracted the return and we will finalize the process.

Refund of money

If the Customer returns products, the value equal to the price of the returned products will be refunded. There will be no refund of shipping costs.
Partial returns and partial order cancellations will give rise to partial refunds. aurora will accept order cancellations when requested prior to shipment of the order. To make the cancellation the Customer must contact aurora.
The refund will be made to the Customer’s bank account whether credit or debit. The term is 30 working days.
If it is a credit card, it will depend on the cut-off dates of the card and the times of the financial entity; this can take up to 2 months.
If the payment was made in cash. The refund will be made to a debit account.

Guarantees

To make effective a guarantee the Client has two options:
Approach our workshop in the Historic Center of Cartagena, with the clothes and the corresponding purchase invoice; or contact our hotline and/or our social networks for approval, pick up the defective clothes and send the new one. aurora assumes all shipping costs (for exchanges and warranties).
The warranty will lose its validity after 60 calendar days from the date of purchase, or in case of defects or deterioration caused by external factors such as accidents, wear and tear due to use and washing, or care not in accordance with the instructions given on the internal labels of the clothing.

The warranty does not cover products modified or repaired by the Customer and does not cover products damaged by improper use.
If the customer receives a package with a missing item, he/she must contact aurora within a period of time not exceeding 5 working days to carry out the respective investigation of the case and will receive an answer about it as soon as possible.

ACCESS TO AURORA CONTENT

Customers and Users are fully responsible for their conduct when accessing the information on the website while browsing it, as well as after having accessed it. As a consequence of the above, Customers and Users are solely responsible to aurora and third parties for any consequences that may arise from their use:
aurora reserves the right to update the contents when it sees fit, as well as to eliminate them, limit them or prevent access to them, temporarily or definitively, as well as to deny access to the website by Clients and Users who misuse the contents and/or breach any of the conditions that appear in this document.

INTELLECTUAL PROPERTY

aurora has all rights over the content, design, layout and source code of this website and, in particular, over the photographs, images, logos, clothing designs, trademarks and trade names included in the website.
